Price Close Always Above (or below) 40 EMA

Greetings. I'm requesting help for a scan that returns results: Price close has been above (or below) the 40 EMA for the entire day's trading session on a 5 minute chart.
Couldn't find an existing post that addresses this and I couldn't get a solution using the condition wizard. Thanks in advance for your assistance with this.

Put this in the scanner set to 5m with ext checked

def cond = if secondsfromTime(0930)==0 and close>ema
           then 1
           else if secondsfromtime(1600) < 0 and (cond[1]==0 or (cond[1]>=1 and close<ema))
           then 0 else cond[1];

plot scan = cond == 1;

Put this in a 5m 30d chart to test results

Solution
This script works great, thank you. I've been trying to modify it so that one version is used for price over the EMA and the other price under the EMA. It was a little confusing for me to try managing a watchlist with the combined over/under. Could I please get help with the two versions? I just can't figure out the change to make. Thanks!

This seems to worrk with the exception of a few lightly traded stocks.

def cond = if secondsfromTime(0930)==0 and close<ema
           then 1
           else if secondsfromtime(1600) < 0 and (cond[1]==0 or (cond[1]>=1 and close>ema))
           then double.nan else cond[1];

plot scan = if !isnan(cond) then 1 else 0;
